Event Organizer Terms and Conditions

Introduction

These Terms and Conditions are designed for Event Organisers who wish to use theEticket, operated by P & A BUSINESS GROUP PTY LTD (ABN: 57 650 076 430), for the purpose of listing, promoting, and selling tickets to their events. By using our services, you agree to comply with these Terms and Conditions.

Account Registration and Use

  • Event Organisers must register for an account to list an event on theEticket platform.
  • You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
  • theEticket reserves the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, not current, or incomplete.

Event Listings and Content

  •  You are responsible for providing accurate, non-misleading information about your events, including dates, locations, and prices, and for updating this information if it changes.
  • You grant theEticket a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute the content related to your events for the purpose of promoting your event and facilitating ticket sales.
  • You are responsible for ensuring that the content of your event listing does not violate any applicable laws or regulations, infringe on any intellectual property rights, or contain any libelous, defamatory, or otherwise objectionable material.

Ticket Sales and Revenue

  •  theEticket will process ticket sales on your behalf and will collect payments from ticket buyers via the payment options available on our platform.
  • Revenue from ticket sales, minus any applicable fees as agreed upon, will be remitted to you according to the payment terms specified in your agreement with theEticket.
  • You are responsible for setting the ticket prices and for any taxes, levies, or charges imposed on the ticket sales by any governing body.

Cancellations, Refunds, and Changes

  • You must clearly communicate your refund and cancellation policy to ticket buyers at the time of purchase.
  • In the event of an event cancellation, postponement, or significant change, you are responsible for issuing refunds in accordance with your refund policy and the Australian Consumer Law.
  • theEticket reserves the right to issue refunds to ticket buyers on your behalf in certain circumstances, such as event cancellation, in accordance with our Refund Policy and the Australian Consumer Law.

Indemnity

You agree to indemnify, defend, and hold harmless theEticket and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your event listings, your breach of these Terms and Conditions, and your violation of any laws or regulations.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Western Australia, and you agree to submit to the exclusive jurisdiction of the courts of that State.

Changes to Terms and Conditions

theEticket reserves the right to modify these Terms and Conditions at any time. We will provide notice of any changes by posting the updated Terms and Conditions on our site and updating the "effective date" at the top of these Terms and Conditions.
